Terms of Use

These terms govern your use of terramod.com.au (the "Site"), operated by Terramod Pty Ltd (ACN 697 689 697) ("Terramod", "we", "us", "our"). By using the Site you agree to these terms. If you do not agree, please do not use the Site.

1. About the Site

The Site is a marketing and information channel for Terramod's modular and prefabricated dwelling products and services. The Site does not, on its own, constitute an offer to sell, supply, build or install any product. Any supply will be governed by a separate written agreement with Terramod.

2. Information is general only

Content on the Site, including renders, photographs, floor plans, dimensions, timelines, indicative pricing and sustainability information, is provided for general information only. It is indicative, may change without notice and does not constitute professional, design, engineering, planning, financial or legal advice. You should obtain independent advice before making any decision.

3. Indicative pricing

Any prices shown on the Site are indicative starting prices in Australian dollars and may exclude site works, transport, craneage, foundations, services connections, council fees, certification, finishes upgrades, GST or other project-specific costs. Final pricing is set out in a written quote or contract.

4. Your consumer rights

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other law that cannot be excluded by agreement.

5. Acceptable use

You agree that you will not:

  • Use the Site for any unlawful purpose or in breach of these terms.
  • Attempt to gain unauthorised access to the Site, its servers or any related systems.
  • Interfere with or disrupt the Site, or transmit viruses, malware or harmful code.
  • Scrape, harvest, mine, frame or republish content from the Site, including for training machine-learning models, without our prior written consent.
  • Use the Site or our brand to mislead any person about an association with Terramod.

6. Intellectual property

All content on the Site, including text, graphics, logos, the "TERRAMOD" name and word mark, photographs, renders, videos, designs and source code, is owned by or licensed to Terramod and is protected by Australian and international copyright and trade mark laws. You may view and print pages for your personal, non-commercial use. All other use requires our prior written consent.

7. Submissions and enquiries

If you send us an enquiry, brief, site details, images or other materials, you confirm that you are entitled to provide them and you grant Terramod a non-exclusive licence to use them for the purpose of responding to your enquiry and progressing any subsequent engagement. We handle personal information in accordance with our Privacy Policy.

8. Third-party links and content

The Site may contain links to or embed content from third parties (for example Instagram, Vimeo or YouTube). We do not control and are not responsible for the content, products, services or practices of those third parties. Your use of third-party services is governed by their own terms.

9. Disclaimer

Subject to clause 4 (consumer guarantees), the Site and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Terramod does not warrant that the Site will be uninterrupted, error-free, secure or free from viruses, or that any information on it is current, accurate or complete.

10. Limitation of liability

To the maximum extent permitted by law, Terramod is not liable for any indirect, special or consequential loss, loss of profits, loss of revenue, loss of data or loss of business opportunity arising out of or in connection with your use of the Site. Where liability cannot be excluded but may be limited, our liability is limited (at our option) to re-supplying the relevant content or paying the cost of having it re-supplied.

11. Indemnity

You agree to indemnify Terramod against any loss, damage, cost or expense we suffer or incur arising from your breach of these terms or your misuse of the Site, except to the extent caused by our own negligence or wilful misconduct.

12. Changes to the Site and these terms

We may update, suspend or discontinue the Site (or any part of it) and may update these terms at any time by posting an updated version on this page. Your continued use of the Site after we post changes means you accept the updated terms.

13. Governing law

These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.
